These Terms of Service ("Terms") govern your use of the RiverRun mobile application and related services operated by RiverRun LLC ("RiverRun," "we," "our," or "us"). By creating an account or using RiverRun, you agree to these Terms. If you do not agree, do not use RiverRun. RiverRun may update these Terms at any time. Your continued use of the Platform after any update constitutes acceptance of the revised terms.
⚠️ Important: RiverRun is a technology marketplace platform that connects riders with independent drivers. RiverRun is not a transportation provider, motor carrier, or outfitter. All transportation services are provided solely by independent contractors. RiverRun does not own or operate vehicles and does not employ drivers.

1. The RiverRun Platform

RiverRun is a technology marketplace platform that connects paddlers ("Riders") with independent third-party drivers ("Drivers") for transportation between river access points. RiverRun provides the technology platform, processes payments, facilitates ride coordination, maintains ride records and communication tools, and implements safety and operational controls.

RiverRun does not provide transportation services and is not a motor carrier, transportation provider, or outfitter. All transportation services are provided solely by independent Drivers who operate their own vehicles and businesses.

3. Driver Approval and Independent Contractor Status

All Drivers must complete RiverRun onboarding and screening requirements prior to activation, which may include identity verification, driving history review, motor vehicle record review, background screening, and insurance verification. Drivers are not permitted to accept rides until approved by RiverRun.

RiverRun's approval of a Driver does not constitute an endorsement, guarantee, or warranty regarding the Driver's fitness, skill, knowledge of local waterways, or quality of service. Drivers are independent contractors — not employees, agents, joint venturers, or partners of RiverRun.

4. Bookings and Payments

Booking a shuttle

When you submit a ride request, your payment card is authorized for the ride amount. An independent Driver may then accept your request. Payment is captured only after the shuttle service is completed.

Pricing

Fares are quoted prior to booking and may vary based on route, distance, number of Riders, and equipment. All prices are displayed before booking confirmation.

Payment processing

Payments are processed by Stripe. RiverRun acts as a payment collection agent and deducts applicable platform service fees. RiverRun does not store full payment card information. By using RiverRun, you agree to Stripe's terms of service.

Driver payouts

Drivers receive 67% of the total fare for each completed shuttle. Payments are remitted on a regular schedule determined by RiverRun.

5. Cancellation Policy

You may also be charged for damage to a Driver's vehicle or excessive cleaning (up to $150). Damage or cleaning claims must be reported within 24 hours with supporting documentation.

6. Equipment Transport

You are solely responsible for your equipment and ensuring it is safely prepared for transport. YOU WARRANT THAT YOUR EQUIPMENT IS IN SAFE AND TRANSPORTABLE CONDITION.

RiverRun and Drivers are not responsible or liable for any damage, loss, or injury caused by improper loading, shifting or detachment of equipment, or failure of racks, trailers, straps, or securing systems. Drivers may assist with loading as a courtesy but do not assume responsibility for your equipment. Drivers may refuse transport of unsafe, improperly secured, or excessive loads.

All users must comply with the RiverRun Community Guidelines. RiverRun has a zero-tolerance policy for physical violence or threats, verbal abuse or harassment, sexual misconduct, discrimination, illegal activity, and substance use or impaired riding.

Drivers may refuse or terminate a ride at any time if conditions are unsafe, unlawful, or inconsistent with these guidelines. Drivers have final discretion to refuse or terminate a ride they believe is unsafe.

9. Insurance

⚠️ RIVERRUN DOES NOT PROVIDE PRIMARY AUTO, MEDICAL, OR PERSONAL LIABILITY INSURANCE FOR RIDERS. Any claims arising from transportation services, including vehicle-related incidents, must be directed to the Driver's insurance provider.

Drivers are required to maintain automobile liability insurance with minimum coverage limits of $100,000 bodily injury per person / $300,000 per accident / $50,000 property damage, or such higher amounts as required by applicable law. Drivers are solely responsible for maintaining insurance appropriate for compensated transportation activity.

10. Safety and Risk Assumption

Paddle sports and transportation activities involve inherent risks including motor vehicle accidents, equipment failure, road hazards, weather and environmental conditions, and remote or limited-access locations. You voluntarily assume all risks associated with your participation in transportation and river-related activities.

RiverRun does not represent or warrant that any Driver has knowledge of local waterways or water conditions. Riders are solely responsible for their own safety on the water.

11. Release of Liability

PLEASE READ CAREFULLY. YOU ARE WAIVING LEGAL RIGHTS. To the maximum extent permitted by law, you hereby release, waive, and discharge RiverRun, its officers, owners, affiliates, and Drivers from any and all claims, liabilities, damages, or causes of action arising out of or related to your use of the Platform, including claims based on ordinary negligence.

12. Indemnification

You agree to defend, indemnify, and hold harmless RiverRun LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your equipment, your conduct, your violation of these Terms or Community Guidelines, or any transportation services you provide or receive.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIVERRUN'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC RIDE GIVING RISE TO THE CLAIM.

14. Force Majeure

RiverRun and Drivers are not liable for delays, cancellations, or failure to perform due to events beyond their control, including weather conditions, flooding, unsafe river conditions, road closures, traffic incidents, or mechanical issues.

15. Communications Consent

You agree to receive communications (including SMS, push notifications, and email) from RiverRun and Drivers for purposes related to ride coordination, safety, and service updates.

17. Governing Law and Arbitration

These Terms are governed by the laws of the State of Indiana. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration on an individual basis. You waive the right to a jury trial and participation in any class action or collective proceeding to the fullest extent permitted by law.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
